Because it can’t be considered a “tangible personal property,” compressed air offered by machines to inflate motor vehicle tires may not be subject to the state’s sales tax, the Commonwealth Court has ruled.
Key to the determination in the matter, which was an issue of first impression for the court, was the fact that the owner of the machines was not “charging” for air, but the right to use the machine for a set period of time.
