Winning the “race to the courthouse” doesn’t always work to a litigant’s advantage.

A federal judge in Philadelphia has ruled that although Getty Petroleum was the first to file suit in its disputes with Atlantis Petroleum — a Pennsylvania firm that operates 71 gas stations — the status of filing first was no bar to issuing an injunction against Getty that effectively blocks it from pursuing the first case.
