Effective Feb. 23, the American Land Title Association (ALTA) and the National Society of Professional Surveyors Inc. (NSPS) jointly revised the “Minimum Standard Detail Requirements for ALTA/ASCM Land Title Surveys,” commonly known as the “ALTA Standards.” This is the seventh set of revisions since the ALTA Standards were first promulgated in 1962, and revisions seem to be coming out at a quickening pace in recent years; the last set of changes was issued in October 2005 and became effective on Jan. 1, 2006.

While several of the changes are intended simply to provide greater clarity and organization to the ALTA Standards, there are also a number of substantive changes, some of which will serve to benefit survey users, and others that may create questions and concerns for those parties. In this latter category, the most important changes appear to be new language, which may give rise to questions concerning the availability of certain assurances previously provided by surveyors as a matter of course, and other provisions that seem intended to shift the burden with respect to who is responsible for researching zoning and certain other background information.
