A Superior Court panel being asked to reconsider a decision waiving an appeal of an $18.5 million verdict for failure to file post-trial motions went back on its decision to accept an amicus brief from several appellate lawyers opposed to the ruling and denied the Pennsylvania Bar Association the opportunity to file a brief.

In a one-page order last week in Newman Development Group v. Genuardi’s Family Market Inc. , the panel led by Superior Court President Judge Correale F. Stevens struck an amicus brief filed last month by appellate lawyers at seven of the state’s law firms in support of supermarket chains Genuardi’s and Safeway.
