Consistent with this monthly column on attorney liability, every attorney should know the “law of legal malpractice” — if for no other reason than to properly adjust one’s own liability for inevitable human error.

Before discussing, it is imperative for all attorneys to have professional liability insurance through a reputable carrier with affordable premiums directly related to policy limits, erring on the side of a larger deductible for greater coverage. Likewise, every attorney should immediately report “occurrences” as they arise — i.e., when he discovers his neglect has the outer-most possibility of leading to a claim — not when the legal malpractice lawsuit is filed and served.
