Commonwealth v. Solomon, PICS Case No. 11-3814 (Pa. Super. July 22, 2011) Gantman, J. (21 pages).

The Superior Court held that prosecutor’s statements made during closing were “mere oratorical flare” and made in fair response to appellant’s demeanor, testimony at trial and defense counsel’s strategy and did not prevent the jury from properly weighing the evidence and rendering a true verdict. In addition, the trial court properly ordered appellant to pay restitution directly to victim because the medical provider was not a direct-loss victim under the restitution statute. Judgment of sentence affirmed.
