On June 30, the 3rd U.S. Circuit Court of Appeals handed down its decision in United States ex rel. Wilkins v. United Health Group Inc. , a False Claims Act case. A few weeks earlier, the 1st Circuit handed down its decision in United States ex rel. Hutcheson v. Blackstone Medical , another False Claims Act case that addresses some of the same issues. For practitioners in the false claims arena, a comparison of the two opinions is enlightening.

The False Claims Act imposes stiff penalties on anyone who knowingly presents, or causes to be presented, a false or fraudulent claim to the federal government.
