A state Superior Court panel has affirmed a declaratory judgment absolving an insurance carrier from providing underinsured motorist coverage for a man who was thrown from a motorcycle.
The split panel said that a Western Pennsylvania man who was hurt when he was ejected from his 2005 Harley Davidson motorcycle could not claim that he wasn’t injured while “in, on, getting into or getting out of” the vehicle.
