The 3rd U.S. Circuit Court of Appeals has revived a legal malpractice suit after finding that the lower court improperly dismissed it for lack of expert witness support despite the plaintiff’s insistence that her claim could be proved without any experts.

“Pennsylvania law expressly allows a plaintiff to proceed on the basis of a certification that expert testimony will not be required to prove her claim,” U.S. Circuit Judge Richard L. Nygaard wrote in his 16-page opinion in Liggon-Redding v. Estate of Sugarman .
