An offender’s acceptance into Accelerated Rehabilitative Disposition for a second DUI charge triggers the recidivist requirement for installing an ignition interlock system in one’s car, a sharply divided state Supreme Court has ruled.

A 4-3 panel held that, while accepting ARD did not constitute a DUI conviction, the statute’s language should nonetheless be construed to mean that taking the rehabilitative program establishes a violation.
