A Pennsylvania man suing a bankrupt doctor did not release the doctor from the medical malpractice suit by limiting recovery to the physician’s insurance limits in an attempt to greenlight malpractice litigation, a Lackawanna County judge has ruled.
The decision, from Common Pleas Court Judge Terrence R. Nealon, means that a Scranton hospital and other defendants must remain in the lawsuit and potentially face vicarious liability claims.
