A Lackawanna County judge has denied the request of a former construction worker who was crushed under a 1,000-pound slab of concrete to discover the financial worth of the company whose employee he claims was removing the sidewalk 10 feet above him at the time of his injuries.

However, Common Pleas Court Judge Terrence R. Nealon’s decision earlier this month wasn’t all bad news for Daniel James Genevich, who suffered permanent injuries to his spine, knees and kidneys in the 2007 accident. While Nealon denied Genevich’s pretrial motion for leave to conduct punitive damages discovery because he had not included a punitive damages count in his complaint, the judge left the door open to revisit the issue.
