The Pennsylvania Superior Court, reaffirming its holding that violations of other Pennsylvania laws may be relevant to proving bad faith, has granted a new trial to a Pennsylvania couple pursuing a bad-faith claim against their insurance carrier.
One attorney specializing in bad-faith litigation said the case marked the first time he had seen a court use the Unfair Trade Practices and Consumer Protection Law in combination with Pennsylvania’s bad-faith statute.
