In my experience, many experts who testify predominantly for the defense have little real-life experience in job placement.
In a personal injury setting, or even more so a workers’ compensation setting, the injury will often result in economic loss to the injured party. That economic loss can come in many forms: Medical expenses, out-of-pocket expenses, past wage loss and future wage loss are the most common. In order to properly present a plaintiff’s claim for past and future wage loss, the plaintiffs attorney must retain a vocational expert, expert economist or both. Likewise, the defendant in such actions will hire his or her own vocational expert or expert economist. This article will focus on cross-examining the defense vocational expert.
