The inclusion of a subcontractor’s bid as part of the general contractor’s overall bid for work does not create a contractual relationship between the subcontractor and the general contractor, the Commonwealth Court has ruled.
In an apparent issue of first impression, a unanimous three-judge panel decided that Fisher Associates, the subcontractor, was not a party to the November 2000 contract between Galway Bay Corp. and the Municipal Authority of Monongahela, Pa., for a sewage plant renovation job even though Fisher’s name was on the overall bid proposed to the authority. Fisher was not, however, mentioned in the actual contract.
