A local landlord organization and the Pennsylvania Residential Owners Association have lost their bid before the Commonwealth Court to broadly invalidate an ordinance imposing affirmative requirements on owners and landlords of Berwick Township rental properties.
However, the ordinance’s most intrusive provisions, which would place landlords in their tenants’ shoes in terms of property upkeep and disruptive tenant behavior, had already been struck down by the Columbia County Court of Common Pleas and the intermediate appellate court declined to disturb that decision.
