Federal judges are looking to the New Jersey Supreme Court for help in deciding the scope of the state’s Affidavit of Merit Statute.
On August 17, the U.S. Court of Appeals for the Third Circuit certified two questions: whether the law applies to claims for property damage and whether it applies to intentional torts, not just negligence claims.
