The state Superior Court has withdrawn an opinion in which three of its members appeared to set out a new rule requiring that litigants in Orphans’ Court appeals file exceptions in order to preserve an appeal about the weight of the evidence.
Instead, the case will be listed before the next available en banc panel, according to the court’s order.
