Evidence of Other Wrongs Pa.R.E. 404 Prejudice vs. Probative Value Insufficient Nexus
Commonwealth v. Richards, PICS Case No. 12-1977 (C.P. Lackawanna Oct. 12, 2012) Nealon, J. (7 pages).
The court found that the content of a pornographic DVD and the criminal conduct allegedly committed by defendant involving the sexual abuse of minor children was too attenuated; therefore, its probative value did not outweigh its potential for prejudice. Motion in limine to introduce evidence of other crimes, wrongs or acts under Pa.R.E. 404(b) was denied.
