A federal judge has dismissed two of three counts against Aetna Life Insurance Co. in a suit where the plaintiff is seeking to recover life insurance benefits she said she is owed under ERISA.

But neither of the claims is designed to effectuate an employee benefit plan offered under the federal Employee Retirement Income Security Act, the judge said. Rather, the claims are focused only on the plaintiff’s benefit.
