Post-Conviction Relief Act claim of ineffective assistance of preliminary hearing counsel lacked merit where counsel spoke to defendant about the filed charges the day of the preliminary hearing, calculated a reasonable defense strategy regarding the issue of identification, and committed no error by not moving to dismiss the case because of discrepancies between the suspect description in the complaint affidavit and defendant. Affirmance recommended.
