A Monroe County judge has dismissed a property assessment company from a lawsuit alleging the company breached its duty to the buyer of a Pocono Mountains resort, holding that the company had entered into a contract with the financing company behind the purchase, not the buyer itself.
Court of Common Pleas Judge Stephen M. Higgins granted summary judgment motions from defendant LandAmerica Assessment Corp. related to breach of contract and tort claims. Higgins rejected the argument of plaintiff Hospitality Associates of Tannersville that it was an intended third-party beneficiary of the contract between its investment management shop, Marathon Asset Management, and LandAmerica, whom Marathon had sought out to do the property assessment.
