Determining corporate citizenship, which dictates jurisdiction, has divided district court judges, leading the U.S. Court of Appeals for the Third Circuit to hear a case brought by "thalidomide babies" against GlaxoSmithKline on an expedited basis since the legitimate location of GSK Holdings’ principal place of business is in dispute.
GSK argues that it is a citizen of Delaware, allowing for diversity jurisdiction in federal court. The plaintiffs argue that it is a citizen of Pennsylvania, requiring the case to be remanded to the Philadelphia Court of Common Pleas.
