The Pennsylvania Superior Court may be poised to retract a new rule requiring that litigants in Orphans’ Court appeals have to file exceptions in order to preserve appeals about the weight of the evidence.
During en banc oral arguments Tuesday, some members of the nine-judge panel indicated they do not favor keeping the rule.
