The patient safety report (PSR) at issue was created for the purpose of compliance with PRPA and MCARE and thus, even factual statements within it were not original source documents that were discoverable under PRPA and MCARE; however, defendants failed to prove that the PSR was privileged under PRPA or MCARE because they failed to prove that it was ever reviewed by a peer review committee. Plaintiff's motion to compel production granted.
