The Commonwealth Court has vacated a nearly $200,000 judgment, which included a penalty and attorney fees, against West Allegheny School District and in favor of a sheet metal subcontractor that had done work on a project to remodel West Allegheny High School.

In an unreported opinion issued May 6 in F. Zacherl v. Flaherty Mechanical Contractors, a three-judge panel reversed Allegheny County Court of Common Pleas Judge Judith L.A. Friedman’s ruling that granted summary judgment in favor of plaintiff F. Zacherl Inc. and awarded the company about $200,000 in damages for breach of contract.
