The state Superior Court has ruled that the owner and operator of a man-made Pennsylvania lake is not liable in a boating accident in which two men were injured and their vessel was damaged.

The unanimous three-judge panel rejected the arguments of three plaintiffs aiming to bring claims against the owner of the lake, PPL Holtwood, on theories of negligence and gross negligence after they suffered injuries during a collision with another boat. PPL Holtwood and other related defendants own and operate Lake Wallenpaupack and use it to generate hydroelectric power through a license with the Federal Energy Regulatory Commission, according to the court’s opinion.
