Appellant did not waive his appeal rights as a result of his failure to properly serve the trial court judge because the trial court's order was inconsistent with Pa.R.A.P. 1925(b); the trial court erred by not holding an evidentiary hearing and requiring the commonwealth to establish that it no longer possessed appellant's property. Vacated.
