The state Superior Court has thrown out a suit filed by former Superior Court Judge Michael T. Joyce, in which he claimed two insurers committed fraud when they entered into favorable settlements with him following an automobile accident without requiring him to provide a statement under oath or submit to an independent medical examination.
In Joyce v. Erie Insurance Exchange, a three-judge panel unanimously upheld a ruling by the Court of Common Pleas of Erie County sustaining the preliminary objections of defendants Erie Insurance Exchange and State Farm Mutual Automobile Insurance Co. Joyce was convicted in 2008 on charges that he lied about neck and back injuries and abused his position on the bench to receive a combined $440,000 payout from Erie Insurance and State Farm following a slow-speed automobile accident.
