Obamacare's amendment to the Black Lung Benefits Act allows the widows of coal miners to collect benefits when they file a claim for benefits previously denied to them, the U.S. Court of Appeals for the Third Circuit has ruled.
The 2010 Patient Protection and Affordable Care Act, commonly called Obamacare, revived a piece of the BLBA that had entitled widows to collect benefits if they could show that their husbands had been awarded benefits at some point in their lifetime. Congress had removed that provision from the BLBA in 1982 because of a sharp increase in claims, according to the Third Circuit's opinion, and left the section requiring that a widow prove that her husband's death was directly caused by pneumoconiosis in order to get benefits.
