A former Luzerne County court official who pleaded guilty to a federal bribery charge was not deprived of his constitutional due process rights when his retirement benefits were rescinded, the U.S. Court of Appeals for the Third Circuit has ruled.

In so holding, the panel avoided the thorny question of whether or not a federal corruption charge is similar enough to a parallel state crime to trigger a Pennsylvania statute that requires public officials to forfeit their retirement benefits when they plead guilty to taking a bribe in office.
