In a case brought by an energy industry publisher alleging copyright infringement against a steelworkers' union that distributed its electronic newsletter to several executives from a single subscription, a federal judge has ruled that summary judgment would be premature on nearly all issues.

United Steelworkers, or USW, based in Pittsburgh, had made several affirmative defenses after the Energy Intelligence Group, or EIG, brought its copyright infringement suit in 2011 based on the union's distribution of its Oil Daily newsletter, called OD for short, which EIG has produced since 1951 and converted to an electronic-only format in 1999.
