Penn State Milton S. Hershey Medical Center recently agreed to settle a medical malpractice wrongful-death suit for $2.4 million in Dauphin County. The plaintiff alleged that the hospital failed to properly diagnose a woman’s vulvar cancer.

The settlement agreement in Berry v. Milton S. Hershey Medical Center allocates 80 percent for the wrongful-death claim and 20 percent for the negligence claim. The settlement also stipulates that firms handling the plaintiff’s claims will receive 40 percent of the settlement, or $960,000, in attorney fees, and an additional $15,715 in costs. Under the agreement, Villari, Brandes & Giannone will receive $591,715 and Handler Henning & Rosenberg will receive $384,000.
