The Pennsylvania Superior Court has revived a brain-cancer-cluster lawsuit against Rohm and Haas, determining that the trial judge overstepped his authority in tossing out the suit before the plaintiff finished presenting her case.

In Branham v. Rohm and Haas, a three-judge panel overturned Philadelphia Court of Common Pleas Judge Allan L. Tereshko’s issuance of a nonsuit in favor of Rohm and Haas, currently owned by Dow Chemical Co.
