New Jersey law should govern a pharmaceutical products liability case, a federal judge in Philadelphia has ruled, holding further that under the Garden State’s products liability law, a Pennsylvania doctor named as a defendant should be dismissed as fraudulently joined.
U.S. District Senior Judge Robert F. Kelly of the Eastern District of Pennsylvania declined to remand the case to the Philadelphia Court of Common Pleas and decided to transfer the case to the U.S. District Court for the District of New Jersey.
