The Pennsylvania Superior Court has ruled that a Luzerne County trial judge should have held the owner of a company personally responsible for the company’s violation of several court orders requiring it to respond to discovery and other requests.
A three-judge panel of the court unanimously reversed Luzerne County Court of Common Pleas Judge Lesa Gelb’s ruling denying plaintiff James Yoho’s fourth and fifth petitions seeking to find Donna Deitrick, the sole owner and operator of defendant Asbestos Removal Control, in contempt for her company’s failure to comply with orders.
