The American Arbitration Association (AAA) has revised its Commercial Arbitration Rules. The revised rules, which apply to any claim filed on or after Oct. 1, 2013, are designed to enhance significantly the efficiency of the arbitration process. Mediation. In recognition of the wide acceptance of mediation and its record of being highly effective in resolving parties’ disputes, the AAA has created a new rule, R-9, requiring the parties to mediate any dispute more than $75,000. Any party may unilaterally opt out, or the parties may agree to forgo mediation. The mediation takes place concurrently with the arbitration, and in accordance with the AAA’s Commercial Mediation Procedures, but the mediator may not also serve as the arbitrator unless agreed upon by all parties and the mediator. No additional filing fee is required for the mediation.
