I have just been appointed in a criminal case by the court of common pleas in my county. I don’t want to take the case. Further, the client and I have a fairly major disagreement dealing with issues of ethics and honesty. What can I say in my withdrawal petition?
Once a lawyer is entered of record, the only way a lawyer can be discharged is with court approval. This is particularly true if a court has appointed a lawyer. The lawyer can’t just walk away from the case. The lawyer must seek court permission to withdraw if the lawyer is entered of record.
