The constitutional rights of a man whose asbestos-related claims were barred because of the amount the defendant had paid out in previous litigation were not violated, a Philadelphia judge has ruled in an apparent case of first impression.

In Markovsky v. Crown Cork & Seal, Philadelphia Court of Common Pleas Judge Arnold New ruled Jan. 8 that the dismissal of James Markovsky’s claims against Crown Cork & Seal Co. should stand on appeal.
