Some inventors create inventions they believe are the next greatest thing since the smartphone, personal computer or assembly line. They explain in great lengths that they have never seen anything similar out in the marketplace and since they have spent many hours testing and tinkering to perfect their invention, they believe it deserves a patent. However, this isn’t necessarily true. Just because something similar isn’t on store shelves, being advertised in the media, or found on the Internet doesn’t mean that it hasn’t been described in a patent or other published document.
One way to bring clarity to the patent process is to conduct a patentability search of the invention. A proper analysis of the patentability search results will provide the red, yellow or green light in moving forward with a patent application. It will help avoid spending resources on an expensive patent process, when nothing was patentable from the start.
