A federal judge has rejected an injunction sought by officials of five states that would have forced Allegheny Energy Inc. to secure new permits required under the Clean Air Act for modifications to three coal-fired energy plants.
U.S. District Judge Joy Flowers Conti of the Western District of Pennsylvania threw out the case—filed in 2004—concluding that the energy company had no liability for any of the claims with regard to any of the plants, each of which were closed between 2012 and 2013.
