The Pennsylvania Superior Court en banc heard reargument Wednesday over whether the damages portion of a Chester County trial judge’s molded $18.5 million verdict against Genuardi’s Family Markets must be reduced to present value.

In Newman Development Group of Pottstown v. Genuardi’s Family Markets, a three-judge panel of the Superior Court ruled 2-1 last July that the portion of the award comprising $10.5 million in expectation damages stemming from lost rent payments incurred by Genuardi’s landlord, Newman Development Group of Pottstown, after Genuardi’s allegedly backed out of a 20-year lease agreement had to be reduced to present value.
