The son of a man who allegedly underwent several post-mortem surgeries, including a brain removal—against the wishes of his family—is set to have his case against Albert Einstein Medical Center sent to trial.

Philadelphia Court of Common Pleas Judge Frederica Massiah-Jackson denied Einstein’s motion for summary judgment April 22. Plaintiff Douchan Weiley sued Einstein, Temple University School of Medicine and Hancock Funeral Home for tortious interference with a dead body and punitive damages. Temple and Hancock were dismissed from the case in 2010.
