Duane Morris is still facing a legal malpractice case filed in Colorado after a federal magistrate judge there recommended against granting partial summary judgment to the firm and two of its former partners.

The two former Atlanta-based partners, John C. Herman and Allen L. Greenberg, had represented Edward Phillips in a patent infringement case he had filed over his patent for “steel shell modules” for prisons following a jury trial that had ended in his favor.
