Whether the catastrophic failure of a glass manufacturer’s furnace was “sudden and accidental” was again before a federal district judge, after it had already been up to the Third Circuit once before.

In an opinion issued last week, U.S. District Judge Arthur J. Schwab of the Western District of Pennsylvania wasn’t persuaded by the company’s argument that its insurer had acted in bad faith in rejecting a claim for coverage after the incident.
