After having once revived a qui tam suit brought against a Pennsylvania engineering firm, the U.S. Court of Appeals for the Third Circuit has now agreed with the trial court’s decision to grant summary judgment to the firm.
On its second encounter with the case, now with discovery completed, the appeals court decided the contracts on which the case was based were too ambiguous to bear out the allegations that the firm had overstated the qualifications of its engineers to jump to higher pay grades.
