The U.S. Supreme Court will not consider whether its decision two years ago deeming life without parole for juvenile murderers unconstitutional should be applied retroactively in Pennsylvania.
On June 9, the U.S. Supreme Court denied certiorari in Commonwealth v. Cunningham. The decision lets stand a ruling from the state Supreme Court that found the U.S. Supreme Court’s 2012 ruling in Miller v. Alabama would not be retroactively applied. Miller held that mandatory life without parole for juvenile offenders is unconstitutional.
