A sign sitting on land owned by the borough of Shickshinny, Pa., that points to a Baptist church with a gold cross and white bible can be challenged as a violation of the First Amendment, the U.S. Court of Appeals for the Third Circuit has ruled, vacating the district court’s decision.

The trial court had ruled that Pennsylvania’s two-year statute of limitations would bar the challenge, which was brought in 2012 over the sign that was installed in 2008.
