Valets do not have a duty to withhold car keys from visibly intoxicated patrons, the state Superior Court has ruled in an issue of first impression.

On June 24, a split three-judge panel of the Superior Court ruled in Moranko v. Downs Racing that Mohegan Sun at Pocono Downs could not be held liable under Pennsylvania law after a valet returned car keys to a plaintiff’s decedent, who was later involved in a fatal car crash. Judge Jack A. Panella, writing for the majority, likened the relationship between the valet and the car owner to a bailor and bailee, and found that no duty existed for the valet.
