Construction claims and expert witnesses are often hand-in-hand propositions. The project is delayed—need to call a schedule/delay expert. The project has roofing leaks and failures—need to call a roofing expert. The project has design flaws that cause additional time and cost—need to call a design expert. The project has a critical failure and workers are injured or, worse yet, killed—need to call engineers and accident reconstruction experts.
Complex technical issues regarding scope and quality of work, time and scheduling and, ultimately, monetary or other loss can quickly subsume a construction project and often give rise to construction claims. Whenever technical construction issues arise on a project that cause additional time and cost, the need for expert investigation and opinion arises immediately. And when construction claims proceed to suit or other dispute resolution proceedings, the expert investigation often must transform into expert reports and testimony.
